It was January 2020 when then-“Empire” star, Jussie Smollett, claimed he was attacked by two presumably white dudes in the late night hours, as he was walking back to his Chicago condo from a local Subway restaurant. As you all know, at that time, Jussie told Chicago PD that the men yelled racial and homophobic slurs to him as they tied a noose around his neck and poured bleach on him before running away. It was only a matter of time before two Nigerian brothers – Abel and Ola Osundairo – claimed Jussie paid them to stage the whole thing. They’d also stated that they were close acquaintances of Jussie’s and met him when they were extras on “Empire.”

Well, fast forward to today (March 10, 2022)…and Jussie has just been sentenced for the crime. He didn’t go to jail without a bang though. According to reports, he had a loud outburst, which was directed toward the judge, moments after learning his fate. Details are below.

Jussie’s Sentencing And Outburst In Courtroom

According to the Associated Press, Chicago Judge James Linn sentenced Jussie to 150 days in the county jail and 30 months of felony probation for the ‘racial/homophobic attack hoax’…ordering Jussie to pay $120,106 in restitution to the city of Chicago, plus a $25,000 fine. In addition to the sentence, Judge Linn also ordered Jussie to be immediately hauled off to jail to begin doing his time.

Soon after the judge handed down the sentence, Jussie — who declined the opportunity to speak prior to the judge’s ruling — stood up and loudly made some bold statements:

Via AP – “If I did this, then it means that I stuck my fist in the fears of Black Americans in this country for over 400 years and the fears of the LGBT community,” Smollett said, standing up at the defense table as his lawyers and sheriff’s deputies surrounded him. “Your Honor, I respect you and I respect the jury but I did not do this. And I am not suicidal. And if anything happens to me when I go in there, I did not do it to myself. And you must all know that.”

As deputies led him from the courtroom, Smollett shouted out again.

“I am innocent,” he yelled, raising his first. “I could have said I am guilty a long time ago.”

Jussie Smollett’s Family Members Asked Judge For Leniency

Prior to the judge handing down his sentencing, prosecutors asked the judge to give Jussie “an appropriate amount of prison time.” While Jussie’s attorneys and family members appeared in court to ask the judge to instead show Jussie mercy.

Jussie’s 92-year-old grandmother, Molly Smollett, said to the judge, “I ask you, judge, not to send him to prison. … If you do, send me along with him, OK?”

Judge Expressed His Discontent With Jussie’s ‘Narcissism And Hypocrisy’

Via AP: Several supporters spoke about worries that Smollett would be at risk in prison, specifically mentioning his race, sexual orientation and his family’s Jewish heritage.

Linn said he did consider those requests for mercy, along with Smollett’s prior work and financial support of social justice organizations. But Linn also excoriated Smollett as a narcissist and pronounced himself astounded by his actions given the actor’s multiracial family background and ties to social justice work.

“For you now to sit here, convicted of hoaxing, hate crimes … the hypocrisy is just astounding,” Linn said.

In 2020, Jussie’s ‘racial/homophobic attack’ claims initially garnered him major support from millions of fans and celebrities alike on social media. At that time, a dozen officers, as well as the FBI worked to catch the ‘racist attackers’ Jussie claimed attacked him. However, once certain details within his story began to unravel during the weeks-long investigation, the support for Jussie transformed into online jokes and/or outrage for him reportedly trying to dupe the public.

Ousted Empire star, Jussie Smollett, is still trying to convince the general public of his innocence -via his legal team- months after claiming he was attacked by two racists White dudes in Chicago, IL. This comes after Chicago P.D. released mounds of evidence from their 2-month investigation. It also comes shortly after a judge allowed for the possibility of Jussie having more charges brought against him in the case.

Newly Released Surveillance Video Of Jussie & “Attackers”

Newly released video footage on the night of the alleged January 29th attack, shows Jussie and the two Nigerian brothers -Abel and Ola Osundairo (who claim Jussie planned the “attack”)- walking down the same deserted block within 27 seconds of each other at approximately 2 a.m.. Several reports suggested that the three men walked directly past each other, yet no  violence ensued. However, Jussie’s team says that cannot be proven:

Jussie’s camp says the new footage is edited together and doesn’t have a time stamp. They point out at no time do you see them on camera passing each other.

Jussie may not be completely out of the woods yet! After a series of leaked texts from District Attorney Kim Foxx surfaced earlier this week. It appears Joseph Magats, the First Assistant State’s Attorney who decided to drop the 16 felony charges against Jussie Smollett. He might have dropped the ball beings though he reportedly never had the legal authority to do so.

According to documents obtained by The Washington, Magats wasn’t legally eligible stand in nor to act as boss for Foxx.

Alan Spellberg, the county’s Criminal Appeals Division Supervisor, was not having it. Chief Deputy State’s Attorney and Chief Ethics Officer April Perry, and senior advisor Robert Foley all received emails February 20. Just one day after Kim Foxx’s recusal from the case was made public.

The email cited legal precedence behind recusals and stated. “My conclusion from all of these authorities is that the [sic] while the State’s Attorney has the complete discretion to recuse herself from any matter, she cannot simply direct someone (even the First Assistant) to act in her stead.”

Too Many Conflicts Of Interest

Foxx released a statement that she recused herself from the case “out of an abundance of caution”. She allegedly had a conversation she had with one of Smollett’s family members about the investigation. Magats was appointed to head the investigation after Foxx recused herself.

The conversation Foxx had was allegedly with former White House advisor Tina Tchen. The advisor reached out to Foxx on behalf of the Empire actor’s family to ask for the FBI to get involved. During the time she was concerned the Chicago PD was leaking information to the press.

To avoid a potential conflict of interest, Foxx’s entire office would’ve had to take themselves off the case. Instead they would’ve had to appoint a special prosecutor. However, Foxx kept it with her office and continued to be involved with the case.

This latest revelation comes just a day after various text messages surrounding the case were leaked. Which also revealed that Kim Foxx said Jussie Smollett was a “washed up celeb who lied to cops.”

Now we just wait to see if they try to reopen the charges or let him walk away.

One day after one of Jussie Smollett’s attorneys was reportedly named as a co-conspirator in an unrelated multi-million dollar extortion case, Jussie has just received good news. In a mysterious turn of events, his attorneys say that ALL of his 16 felony charges have been dropped. He has agreed to do volunteer community service and forfeit his bond. Via Associated Press– Attorneys for “Empire” actor Jussie Smollett said Tuesday that charges alleging he lied to police about a racist and homophobic attack have been dropped.

Smollett attorneys Tina Glandian and Patricia Brown Holmes said in a statement that Smollett’s record “has been wiped clean.” Smollett was indicted on 16 felony counts related to making a false report that he was attacked by two men. …

Among the questions that weren’t immediately answered was whether prosecutors still believe Smollett concocted the attack and whether there’s new evidence that altered their view of events. Typically, a minimum condition of dropping cases is some acceptance of responsibility. In a statement, the Cook County prosecutors’ office offered no detailed explanation.

“After reviewing all of the facts and circumstances of the case, including Mr. Smollett’s volunteer service in the community and agreement to forfeit his bond to the City of Chicago, we believe this outcome is a just disposition and appropriate resolution to this case,” the statement from spokeswoman Tandra Simonton said.

Smollett had made a $10,000 bond payment to get out of jail after his arrest on the charges.

Police and prosecutors have said Smollett falsely reported to authorities that he was attacked around 2 a.m. on Jan. 29 in downtown Chicago because he was unhappy with his pay on “Empire” and to promote his career.
