After Outcry, State Attorney Kim Foxx Defends Smollett Decision But Suggests He’s “Accountable”

State Attorney Kim Foxx suggested that Jussie Smollett is “accountable” for the attack – which, for the record, he’s still claiming he did not stage- and says it’s his choice however he now chooses to “spin” the narrative regarding his actions…

WBEZ: Should he [Jussie Smollett] have been made to stand up in court and plead guilty to something or acknowledge in some way that he did something?

S.A. Kim Foxx: “Should he have had a right to a day in court? That is his choice to make. And should we have said nothing and allowed him to go to trial and also have the possibility that he’s found not guilty? … Not every case that goes to trial has a finding of guilt. And so the assumption, the presumption that if we had taken this case to trial that he would have been found guilty and therefore the justice would have been served — what happens to those who are found not guilty?

In this instance, Mr. Smollett forfeited his $10,000 bond. Mr. Smollett completed community service, and how he chooses to spin why he did those things — what I can tell you is that most people who come through the criminal justice system don’t give up $10,000 of their hard earned money, or engage in volunteer services connected with an alleged offense, without viewing that as a way of being held accountable.”
