Whitney Houston  was married to Brown for 15 years — died in 2012 at the age of 48 after she was found unresponsive in a bathtub at a Beverly Hills hotel. Three years later, Bobbi Kristina died six months after she was found unresponsive in a bathtub in her Georgia home.

“The hardest thing I had to do in my life was tell my daughter to let go,” Brown tells Roberts as he breaks down in tears. “My baby’s gone. I thank God I’m still here.”

A day after Bobbi Kristina’s death, the 47-year-old singer released a statement to ET about his beloved daughter. “Krissy was and is an angel. I am completely numb at this time,” he said at the time. “My family must find a way to live with her in spirit and honor her memory. Our loss is unimaginable.” Source

A Georgia news outlet, 11Alive, filed a legal motion to unseal the autopsy, so that they and the rest of the public can have open access to the details of the results.

Now we know that typically autopsies are usually public record, unless otherwise ordered sealed in a court of law, but in the case of Bobbi Kristina, this just seems more harmful than helpful. If the confidentiality of Bobbi’s autopsy results are detrimental to the investigation, then why do we, the public, need to know THAT badly? In my opinion, we do not need to know, it’s FAR more important for investigators to be allowed to thoroughly do their jobs instead.

Here is what has been reported by 11Alive, the news channel who filed the motion:

A superior court judge has granted a motion to unseal the autopsy report for Bobbi Kristina Brown. Judge Henry M. Newkirk responded to a motion filed by WXIA-TV’s parent company TEGNA Media in the Superior Court of Fulton County.

The motion cites Georgia’s Open Meetings and Open Records Act.

The motion calls for the Court to lift its September 28, 2015 order sealing “the autopsy report, all related investigative reports, all related toxicology reports, the death certificate and any other documents used and/or created by the Medical Examiner’s Office regarding the autopsy of Bobbi Kristina Brown.”

It claims the sealing order should be vacated because it was entered without notice to the public and without an opportunity for a hearing, in violation of the First Amendment to the U.S. Constitution, the Georgia Constitution, and the rules of the court. The motion declares there is no question that autopsy reports are public records which have historically been open to the press and general public.

In its response, the State countered “All public records shall be open for personal inspection and copying, except those by order of a court of this state or by law are specifically exempted from disclosure.”

The State countered that the Open Meetings Act has a provision permitting a public record to be exempt from disclosure by court order. The state argued in court Thursday morning it should remain sealed because it’s part of an ongoing investigation. They say they are still “actively pursing leads” and if unsealed, the autopsy could provide information known only to the state and put people at risk.

The judge told the State it had months to file charges.

“We hope to wrap up before too much longer. We are still actively investigating this case. At this point, it is sensitive information that could jeopardize the case,” the prosecutor responded.

Judge Newkirk said the sealing order arrived on his desk in September of 2015 and the state “seemed anxious to get the order signed”. At the time, the state felt disclosure of the autopsy would create a greater risk of flight. The judge said he expected the press would file an unsealing motion within 15 days. “Had I known that WXIA was at the door at the DA’s office at the time I signed that order, you would have been notified,” Judge Newkirk said. He didn’t know anyone was actively seeking that document or he would have notified WXIA he was asked to sign it, per the Open Records Act. He said he believes the press has deliberately stayed away and given the state time.

According to the motion filed by TEGNA Media attorney Derek Bauer on behalf of 11Alive News, Judge Newkirk did not have access to read the autopsy report he was asked to seal. Bauer says that makes the order “constitutionally flawed and fatally vacated.” He argues the process was flawed not by the state’s request to seal the order, not the judge’s actions.

Attorneys for 11Alive referenced the dramatic rise in heroin in the area. If Bobbi Kristina died from a heroin overdose as some have speculated, it would be in the public’s interest to know, they said.

The judge granted the motion to disclose the records. He will sign the unsealing soon, likely within two days. The Fulton County DA’s office said it will not not appeal. In a release sent Thursday afternoon, D.A. Paul L. Howard said,

“On September 25th, 2015, when my office requested that the autopsy be withheld from the public, we felt that we had valid public safety and investigative reasons for that request. It is our feeling that those valid reasons still exist; however, as citizens and officers of the court we must, nevertheless, follow the orders and instructions of the court.”

Prayers still going up for the Browns and Houstons. Right about now, those two families need all of the positive energy they can get at this very trying time.

Here’s what Atlanta’s WSB-TV 2 has just reported:

County's district attorney does not want Bobbi Kristina Brown's autopsy report released because of a possible danger to witnesses.
Channel 2 investigative reporter Erica Byfield tracked down a document that explains what else the DA told the judge about Brown's high-profile death.
Brown’s court-appointed conservator filed a lawsuit against her former boyfriend Nick Gordon, alleging abuse and theft from Brown.
The suit also claims that Gordon gave Brown a toxic cocktail and then placed her in the bathtub, face-down, causing her irreparable brain damage.
“That whole case hinges on whether Nick Gordon had something to do with Bobbi Kristina's death,” said Atlanta attorney Jamila Hall, who is not associated with the case.
Gordon's attorneys recently filed a nearly 30-page document asking a judge to stay, or temporarily stop, the civil case against him.
Hall believes they did it, in part, to protect Gordon's Fifth Amendment right.
“Anything he says in the civil case could be used against him in the criminal investigation,” Hall told Byfield.
The filing mentions Brown's autopsy. A judge sealed it after the DA's request.
Hall says Gordon's legal team needs it to properly defend him in the civil case.
She believes it's sealed because of its impact on the district attorney's criminal investigation into how Brown died.
“The outcome of the criminal investigation could be quite helpful to Nick Gordon in the civil case and it could also hurt him. It all depends on what comes out,” Hall said.
In addition to mentions possible danger to witnesses, the order to seal Brown’s autopsy also talks about the integrity of the investigation and the risk defendants may flee.
Hall told Byfield that a judge should rule on Gordon's motion in the civil case very soon.'

Like we always say, we do not know the truth surrounding Bobbi Kristina’s untimely death as of yet, but if anyone is involved in her death, we hope the Brown and Houston families get the justice they deserve.
