Just when Jussie Smollett probably began to think that the worse was behind him, regarding his ‘attack’ claim, on Friday (6/21/19) morning, a judge has now delivered a rude awakening to the ousted Empire star. He is now faced with the possibility of having new charges filed against him, over claims that he was fake attacked in a criminal case that caused mass hysteria all over social media and beyond.

What The Judge Has Just Ruled…
A Chicago Tribune reporter, Meagan Crepeau, has just revealed that Judge Michael Toomin ruled on Friday morning, that Cook County State attorney Kim Foxx did not have the authority to appoint her replacement, when she suddenly recused herself from Jussie Smollett’s case. As a result, Toomlin has now ruled that a new special prosecutor be appointed to the case, which that may lead to new charges against Jussie and a whole ‘notha set of problems for him…

R. Kelly and his team have just gotten the news they were apparently trying to avoid from receiving just moments earlier, regarding his pending 10-count sex abuse case in Illinois.

In case y’all hadn’t heard, on Tuesday, May 7, 2019, Kellz and his legal team were “steppin’ in the name of” a legal challenge, all the way to a Chicago courthouse, to oppose Cook County’s State Attorney and prosecutor, Michael Avenatti. About an hour or so later, R. Kelly and his team learned that they’ll be steppin’ right back into the courtroom approximately one month from now, to plead his case in trial.

What Had Happened Was…
R. Kelly and lawyers appeared in court Tuesday, to point out the shady ethical practices that have recently surfaced about two of the main figures spearheading the 10-count sex abuse case against him- State attorney, Kim Foxx and opposing prosecutor, Michael Avenatti.

Kelly’s lawyers argued that given Foxx’s and Avenatti’s now questionable reputations, the authenticity of sex tape(s) they claim to have of R. Kelly having sex with an underaged girl  is also questionable.

“The Bump N’ Grind” singer’s team also requested that the judge ‘preserve’ all texts between Foxx and Avenatti. However, Avenatti, claims he presented all of the text communication between him and Foxx in the Chicago Tribune weeks ago, claiming that there are no more.

There’s more. Kelly’s legal docs pointed out that Avenatti has now publicly confessed that he and Foxx had several conversations and that given the suspected corruption n Empire actor, Jussie Smollett’s case, Kelly suggests that Avenatti is “able to be influenced and wowed.”

Pump The Breaks!

Jussie may not be completely out of the woods yet! After a series of leaked texts from District Attorney Kim Foxx surfaced earlier this week. It appears Joseph Magats, the First Assistant State’s Attorney who decided to drop the 16 felony charges against Jussie Smollett. He might have dropped the ball beings though he reportedly never had the legal authority to do so.

According to documents obtained by The Washington, Magats wasn’t legally eligible stand in nor to act as boss for Foxx.

Alan Spellberg, the county’s Criminal Appeals Division Supervisor, was not having it. Chief Deputy State’s Attorney and Chief Ethics Officer April Perry, and senior advisor Robert Foley all received emails February 20. Just one day after Kim Foxx’s recusal from the case was made public.

The email cited legal precedence behind recusals and stated. “My conclusion from all of these authorities is that the [sic] while the State’s Attorney has the complete discretion to recuse herself from any matter, she cannot simply direct someone (even the First Assistant) to act in her stead.”

Too Many Conflicts Of Interest

Foxx released a statement that she recused herself from the case “out of an abundance of caution”. She allegedly had a conversation she had with one of Smollett’s family members about the investigation. Magats was appointed to head the investigation after Foxx recused herself.

The conversation Foxx had was allegedly with former White House advisor Tina Tchen. The advisor reached out to Foxx on behalf of the Empire actor’s family to ask for the FBI to get involved. During the time she was concerned the Chicago PD was leaking information to the press.

To avoid a potential conflict of interest, Foxx’s entire office would’ve had to take themselves off the case. Instead they would’ve had to appoint a special prosecutor. However, Foxx kept it with her office and continued to be involved with the case.

This latest revelation comes just a day after various text messages surrounding the case were leaked. Which also revealed that Kim Foxx said Jussie Smollett was a “washed up celeb who lied to cops.”

Now we just wait to see if they try to reopen the charges or let him walk away.

Chicago, IL State Attorney, Kim Foxx, has decided to speak out to justify why her office suddenly dropped all 16 felony counts against Empire star, Jussie Smollett.

Many are slamming Foxx’s office and alleging that some shady strings were pulled behind the scenes. That includes Chicago’s mayor, Rahm Emmanuel, and Police Superintendent Eddie Johnson, who obliterated the suspicious ‘secret deal’ Jussie cut to “hide” behind his ‘lies’ about the reportedly staged ‘attack.’

Early Wednesday (March 27th), leaked text messages and emails of Foxx’s reported communications with two of Jussie’s associates surfaced, and the FOP (The Fraternal Order of Police) is now demanding an investigation into her office’s handling of his case.

In a new interview with WBEZ 91.5-Chicago, S.A. Kim Foxx is defending her office’s decision. However, she did not address the leaked info, nor the FOP’s investigation request. Check out some excerpts of her interview below…

One day after Jussie Smollett was suddenly allowed to mysteriously walk away scot-free from a 16 count felony indictment, without any real explanation as to why, more suspicions have been raised

As I expected, there is now more info surfacing of what went down behind the scenes, regarding Cook County, IL State Attorney, Kim Foxx, and two people affiliated with Jussie Smollett.

It’s now been revealed that shortly after Jussie Smollett reported that he was ‘attacked’ by two White dudes in Chicago, State Attorney Foxx was reportedly  contacted by a reported Smollett family member and also a friend of Smollett’s fam.’ Text messages and emails have now leaked, reportedly showing that the two Jussie Smollett associates reached out to the State Attorney, asking for help. From the looks of it, she obliged.
