Just when it seemed that they were THIS close to reaching an amicable resolve in their bitter custody battle, Jennifer Hudson and ex-fiance,’ David Otunga, have just shot that hopeful assumption COMPLETELY down. How so? Well, it’s just been reported that they are officially gonna face-off in trial.

That news comes shortly after they were in the process of trying to reach a settlement over the custody of their son. They’d previously opted to delay a trial date and agreed to finally work out the terms of their legal tug-of-war on their own.

Unfortunately, amidst the constant accusations, disputes, and name calling throughout their lengthy custody journey, their agreement efforts have now apparently fallen to the pits of hell, after they were unable to reach a common ground.

According to The Blast, ‘the trial will begin on August 5, where Hudson and Otunga will testify in court to argue their case. The order notes the trial can continue on for eight days, if needed.’

A Nasty Breakup

Jennifer and David were both engaged for years, however the two of them called it off back in 2017 before they could make that trip down the aisle towards marriage. The emotions surrounding the custody battle, involving their son David Jr., have always been tense including, as The Blast reports, an order of protection against David which granted Jennifer temporary full custody at the time.

According to documents filed in Chicago, Hudson was granted an emergency order of protection after filing on November 16.

Hudson claims on November 15, Otunga pushed her while she was holding their child. She says, “I am afraid that D. Otunga will continue to physically intimidate and abuse me. He has a history of physical and emotional abuse, and I am afraid that his physical attacks will continue to escalate, especially due to the contentious nature of our parentage proceedings.”

David’s team refuted those claims, stating “Mr. Otunga has never abused or harassed Ms. Hudson or their son, and it is unfortunate, especially in today’s climate, that she would feel the need to make these false allegations against him. Mr. Otunga looks forward to his day in court and in being awarded the residential care of the parties’ only child.”

Though Jennifer eventually dropped the petition for the order of protection things have only gotten nastier between the two of them, usually with Jennifer making all of the demands in court. But all of that is about to change since David is requesting Jennifer discuss their relationship issues under oath in front of a judge.

For quite some time now, there has been plenty chatter about an Aretha Franklin biopic coming to fruition. Only a year ago, reports revealed singer Jennifer Hudson was honored at the possibility of portraying the “Queen of Soul” on the big screen. Unfortunately, no further details about the film had been revealed. But in the wake of Aretha Franklin’s death, the highly anticipated biopic has resurfaced as a topic of discussion and reports suggest the timing will likely be much better now.

Aretha’s Request:

According to Hollywood Reporter, the upcoming film’s producers are already discussing how to move forward with its development. Although there’s definitely a lot that goes into the production of a biopic, there’s one part of the process they won’t have to worry about: casting an actress for the leading role. Longtime, legendary music mogul Clive Davis has revealed Aretha Franklin personally told him who she’d like to portray her in the biopic. The Queen of Soul handpicked Jennifer Hudson for the role. In January of 2017, Clive Davis shed light on Aretha’s request and reportedly released statements about the possibility of the film coming together in the near future. “Aretha personally told me that last week,” Clive Davis said at the time.

Definitely Movin’ Forward’:

Now, the film’s heavy hitting production team has released a statement confirming that the show will go on. He’s also shared details about the film’s developmental progress.

“Oh, it’s definitely moving forward,” said Harvey Mason Jr., a longtime music producer for Franklin who’d been working with the singer on the biopic for the past 18 months. “We are going forward and making the movie that Aretha wanted to make.” Still, as of this report, the project has no director, possibly no script (“We’re not really saying,” teases Mason.) and maybe no studio (an MGM rep will not comment on rumors that the studio is interested).

Aretha Made Plans:

According to USA Today, Aretha Franklin reportedly conducted more than 100 calls regarding the biopic. So it’s obvious she had a particular vision for the film and Jennifer Hudson is a big part of her plans. Harvey also recalled the detailed discussions he had with the singer about her biopic.

Franklin contributed her ideas for the film before and after the Hudson announcement. According to Mason, he and Franklin discussed many aspects of the movie right up to last week, during what he describes as “countless hours” of phone conversations.

Over an estimated 100 phone calls, they discussed “what stories she felt were important and what really made her who she is.” They also talked about which songs “were important to her career,” which ones “really told her story” and what should be included in the feature-length film.

So, how do fans feel about the biopic? Well, of course, there have been lots of opinions about it.

Skepticism From Fans:

As expected, the biopic news has garnered tons of reactions from fans of the legendary singer. While many are in agreement with Aretha’s selection, others are a bit skeptical and have taken to social media to drop names of a few other talented singers they believe could also do a great job. Even Audra McDonald spoke out about the starring role for the biopic. The Broadway singer/actress congratulated Jennifer Hudson on landing the role, but also reminded fans the Queen of Soul also dropped her name. The tweet also included the interview where Aretha Franklin discussed the biopic and explained why she’d narrowed the casting down to a select few singers.

Aretha Franklin’s musical legacy spans over 50 years and now the iconic singer is ready to share her story with the world. According to Madame Noire, it has been confirmed that there is an Aretha Franklin biopic in the works and it looks like the upcoming film is a little past the preliminary stages. It has been reported that the “R.E.S.P.E.C.T.” singer has already chosen a singer to portray her in the film. Several news outlets have confirmed that Aretha Franklin has handpicked Jennifer Hudson for the role.

Greatness In The Making:

Although the film has not yet reached production stage, reports suggest that production will begin shortly. On January 27, Deadline revealed that Clive Davis had quite a bit to say about the Queen of Soul during his annual pre-Grammy party. The famed music mogul announced Jennifer Hudson would be starring as Aretha Franklin in the upcoming biopic. The publication also revealed MGM had rights to produce and finance the project.

Producing the film will be Straight Outta Compton‘s Scott Bernstein and music producer Harvey Mason Jr., who has worked with Franklin and also produced music for the film Dreamgirls, on which Hudson won the Academy Award for Best Supporting Actress, alongside Beyonce. Hudson has gone on to a strong career that included the premiere of Monster, which premiered in Sundance.

In addition to being a WWE commentator, David Otunga is also a licensed attorney for the state of Illinois. So from the looks of it, he’s been dusting off his lawyer skills lately and working them overtime. How so? Because every single legal filing Jennifer Hudson has filed against him since they’re split, has been instantly met with a legal challenge by David. Matter of fact, when news recently spread, that JHud had filed yet another legal claim against her ex-fiancee of 9 years, we knew it was only a matter of hours before he’d legally hit back.

Singer/The Voice judge, Jennifer Hudson, and her retired WWE wrestler husband, David Otunga, seemed like they were “Lost In Love” like New Edition for many years. But as most of us know by now, their relationship came to a screeching halt (at least to the public’s eye) when they recently announced they were separating. They were engaged for 9 years and have an 8 year old son, David Jr., together. Unfortunately, their history as a couple wasn’t strong enough for them to work things out and they have quickly progressed to the ‘bitter separated couple’ phase. They’ve gone back and forth in legal filings, with claims of abuse, slander, defamation, contempt of court requests, etc.

JHud’s Request To Judge

Via TheBlast: According to court documents obtained by The Blast, Hudson told the court, as part of the couple’s contentious custody and support battle over their son, that she plans to file a motion to compel Otunga to “seek employment” and “maintain a job diary.” Hudson will not be filing the motions publicly but will present them to the judge later this month. She will also be seeking an order sealing the entire case.

Jennifer was the bread winner in their relationship and David revealed that he mostly raises their son, due to Jennifer’s hectic work/travel schedule. At this point, David has temporary full custody of David Jr.. So that means that JHud may be ordered to pay out even larger child support checks to David, if he does not find a steady job.

It was also reported that Hudson filed another request to have David’s contempt of court notion dropped. He recently requested that she be held in contempt of court, for violating the gag order they both have, regarding the details of their relationship. David said it was Jennifer who wanted the gag order, but instead broke the agreement by talking about him in interviews.

David Otunga Has Many Career Paths To Choose From

By the way, not sure what David’s long-term career will be, but he has quite a few choices with his many professions. He’s a professional bodybuilder, a WWE commentator and he has a Bachelor of Arts degree in Psychology. He is also a Harvard Law graduate and an attorney licensed to practice law in the state of Illinois. We’re not done, Otunga was said to have once worked at Columbia University’s Cognitive Neuroscience Center. Recap Of Their Prior Claims

Throughout their rocky ride, one of the most surprising factors that affected which of them would receive custody of their son, was the restraining order Jennifer filed against her fiancee in November. Soon after she did that, it seems their battle has been a collection of losses for her. Why? Because it’s pretty much looking like what David accused her of doing actually may have some truth to it.

When Jennifer filed her restraining order -claiming that David had pushed her during an argument and left a toy gun on the counter as an intimidation tactic- she was initially granted temporary custody of their son and David was ordered out of their home. However, David immediately began smacking down ALL of J. Hud’s claims, stating that she was making them up because she know that he would be granted custody of their son, given that he’s the one who primarily takes care of their child. He vowed to fight back legally and then suddenly, Jennifer dropped the restraining order against him, as if nothing happened. She also voluntarily gave David temporary sole custody of their son.

David then spoke out again, stating that she did him no favors by dropping her restraining order, she instead did herself one, because he says she was trying to avoid having to testify with “lies” to back up her “false” abuse claims against him.

David Otunga’s Latest Win Against J. Hud

Now, David Otunga just won big, according to TMZ. Authorities have just concluded a very thorough investigation into the domestic battery allegations Jennifer made against her fiancee and it’s just been confirmed that they have now officially dropped the case. The police apparently found no evidence to back up Jennifer’s claims about David.

Pretty sure they both can’t wait until their custody battle is finalized, so they can move on with their lives, because this back and forth drama is taxing.

Why David Otunga Wants Jennifer Hudson Held In Contempt

In his latest legal filing, David says Jennifer violated their gag order after appearing on a television interview and speaking on the matter, as well as showing photos of him and their son, David Jr, and naming him by name. See details below…

Via DailyMail: [David Otunga] filed an emergency petition on December 11, in which he claimed [Jennifer Hudson] has damaged his reputation and has made creating negative press about him her priority, rather than protecting their eight-year-old son, David Jr..

In the documents, David claimed Jennifer issued an exclusive statement to People magazine about their split, saying her actions were ‘solely taken in the best interest of their son’, at the same time he was being served with an emergency order of protection. He alleged the statement damaged his reputation and at the time it was released, he was being forcibly removed from their home in front of their son, and Jennifer wasn’t even there. … The former wrestler went on to claim the ‘Voice UK’ coach and her legal team felt it was more important to issue a press release than give him notice about the petition before or even after it was filed.

According to DM, David is ‘seeking to have Jennifer found in civil contempt of court and sanctioned for her actions.’ He’s also asking the judge to lift the gagging order on him, since he feels that Jennifer cannot seem to abide by the rules. Unfortunately for David, he will have to wait until February to have a hearing on his request though.

Based on how their situation has gone in the short time since they announced the end of their 9 year engagement in November, it’s probably going to get worse before it gets better. We wish them the best possible outcome though and most importantly, hopefully whatever is in the best interest of their son, is the option that is ultimately chosen in the end.

Although Jennifer has dropped the order, David reportedly insists she isn’t doing him any favors. In fact, he believes her decision was actually just a form of damage control so she could avoid testifying to back up her claims. David adamantly argues that he has never behaved inappropriately andhe claims Jennifer is well aware of this and did not fear for the emotional and physical safety of her son as she initially claimed. But of course, Jennifer’s insiders are telling a different story.

Jennifer Hudson’s decision to voluntarily drop the protective order may seem like it was simply an attempt to amicably resolve her differences with David Otunga, but insiders close to the singer claim that isn’t the case. It’s important to note that the decision is only temporary and insiders close to Jennifer insist she would “have no issue testifying in court because she has witnesses to back up her account of the altercation that went down the night before she filed the order of protection.”

It looks like this battle between Jennifer Hudson and David Otunga will be ongoing. In many cases, courts tend to favor mothers where children are considered and we all know celebrities are known to have a bit of leverage with court cases. But, Jennifer’s situation may be a bit different. For those who don’t know, David Otunga isn’t just an attractive wrestler with striking good looks. He’s also a Harvard Law School graduate and shortly after graduating, he joined one of the largest law firms in the United States – Sidney Austin. So, he definitely knows the law.
